Legal Status of Intellectual Property in Iraq

Iraq, like many nations, grapples with substantial challenges in IP protection due to rapid technological advancements and electronic fraud. Historically, Iraq’s IP laws have been inadequate and poorly enforced, resulting in widespread piracy, counterfeiting, and IP rights violations. Despite these challenges, Iraq has made strides in enhancing IP protection, notably joining the World Intellectual Property Organization (“WIPO”) in 1976.

Key legislative measures include:

• Copyright Law No. 3 of 1971, published in the Iraqi Gazette (Issue No. 1957) on January 21, 1971, and amended by Coalition Provisional Authority Order No. 83 of 2004, which introduced provisions on authorship rights, innovation, and penalties for violations.
• Patent Law No. 61 of 1935, repealed by the Patent and Industrial Designs Law No. 65 of 1970, published in the Iraqi Gazette (Issue No. 1865) on April 6, 1970, and further amended by the Patent, Industrial Designs, Undisclosed Information, Integrated Circuits, and Plant Varieties Law No. 58 of 2015, published in the Iraqi Gazette (Issue No. 4395) on January 25, 2016.

Despite these legislative efforts, IP enforcement in Iraq remains deficient, leading to rampant intellectual property violations. The cultural and legal communities in Iraq are eagerly anticipating the enactment of the new IP Protection Law, which has been drafted by the Council of Ministers and submitted to the Council of Representatives. Concurrently, the Ministry of Culture is encouraging creators to register their works and inventions to ensure protection under the forthcoming law.

The Draft Law on Intellectual Property Protection aims to modernize existing laws and align them with global developments, providing a robust legal framework for IP protection. The key objectives include:

Scope of Protection under the Intellectual Property Protection Bill

The draft law encompasses protection for various IP rights, including:

• Plant varieties
• Trademarks, trade names, and geographical indications
• Copyright and related rights

Additionally, the draft law proposes the establishment of the Iraqi Center for Intellectual Property Rights Protection, detailing licensing procedures, financial resources, and penalties to ensure comprehensive IP protection and promote innovation.

Raising awareness about the significance of IP and enforcing related laws are crucial steps towards achieving cultural and economic progress.
