Procurement Case Note (ROI) : Landmark decision of Irish High Court provides welcome guidanceAbnormally Low TendersMay 22, 2024 Eversheds Sutherland is delighted to have advised White Mountain Quarries on its successful High Court challenge to the award of a contract to a competitor who submitted an abnormally low tender to Mayo County Council*. This is the first decision of its kind in the Republic of Ireland and provides welcome guidance on how contracting authorities should recognise and manage low-priced bids. The High Court ruled that the Council failed to identify that the winning bid (for public lighting services) was abnormally low and failed to require the winning bidder to explain its costs in accordance with applicable procurement law.
