Lexology: NYDFS issues guidance to tackle AI-based discrimination in insurance

Eversheds Sutherland Partner Mary Jane Wilson-Bilik is quoted in this Lexology article about new guidance from the New York Department of Financial Services concerning the use of artificial intelligence in the insurance sector. 

“Like Colorado’s law, SB21-169, the NY proposal would prohibit the use of lifestyle data and AI systems in underwriting and pricing if the use would unfairly and unlawfully discriminate against protected classes,” Mary Jane said. “It would require extensive proof of the lack of discrimination by testing that must be comprehensive and documented.”
